Collaborative Law And Mediation

Collaborative law and mediation are separate forms of dispute resolution that are alternatives to traditional family law litigation. These processes are often less expensive, less time-consuming and less stressful than cases that are tried in court. Both forms work best for divorcing couples who are still able to communicate with one another. At Durante, Bock & Tota, PLLC, our attorneys can let you know if one of these processes is the right fit for you. To schedule a consultation at our law offices in Yorktown Heights, call 914-245-6060.

The Collaborative Law Process

A collaborative divorce is best for couples who are able to work together to help determine the terms of their divorce agreement with the help of other professionals, including lawyers for each spouse and, in some cases, a financial planner, child specialists and other professionals. The goal is to minimize conflict while working toward financial and parenting decisions that are fair to each party.

Collaborative law is best for divorcing couples who still have a level of trust in one another, but who still desire separate legal representation. If negotiations breakdown and divorce litigation becomes necessary, the collaborative law attorneys may not continue their representation in the courtroom.

The Mediation Process

Mediation allows divorcing couples to reach an agreement on their terms with the assistance of a neutral, third-party mediator. This is best for couples who still maintain a certain level of respect for one another despite their marriage coming to an end. We can let you know whether this process is right for you and explain in further detail the mediation services that we provide.
