Visitation Rights

There are many cases where fathers face opposition when desiring to visit their child. If you have a child and you have been divorced, or if you have had a child outside of wedlock then you may want to have custody rights or at least visitation rights in order to maintain a relationship with your child. If you are not given custody rights to your child then you may be granted visitation rights as long as it is in the best interest of the child. Any decision made by a court regarding a child will generally be made by the guideline that it must be in the best interest of the child.

In order to obtain favorable visitation rights you must be able to show that this is in the best interests of the child. The various factors that will be considered in determining the best interests of the child may include the following:

  • The child's age, gender, physical and mental health
  • The physical and mental health of the parents
  • Parent's lifestyle and social factors
  • Emotional ties between the parent and child
  • Stability of the environment

There are many other factors that may be considered in addition to any factors that the judge deems relevant.
